Over  Three years ago 46 year old Fausat Ogunbayo, kids were placed in foster care  by the City of New York, Children Services, after receiving  several reports of suspected mistreatment in 2008.  Her sons were 10 and 12 at the time, now they are 16 and 13. The city administration claims,  Ms. Ogunbayo was mentally unstable and had refused treatment, as one of the reasons for removing the kids from her care. The city administration states that Ogunbayo suffers from hallucinations and delusions, and has left the boys at home alone for extended periods while she was working. Their documents also show that she allegedly told a doctor her children’s skin was becoming darker each day, due to radiation.  Ogunbayo once wrote to her children’s school saying that the FBI and Secret Service were out to get the boys, according to ACS court papers.

Ogunbayo claims that the ACS finding is a “Huge lie”. As a result of Ogunbayo’s suffering she has filed a  $900 trillion federal lawsuit against the City Of New York for wrongfully taking her kids away from her.  In the court documents that Ogunbayo filed (She is representing herself)  last week,  she is accusing the Children’s Services and the city of NYC  for causing economic hardship, substantial economic injuries,  and violating her and her children’s civil rights.  She also claims that the city  “recklessly disregarded” her “right to family integrity.”

Ogunbayo is planning to use last months Appellate Panel’s  finding  as a legal defense. The Appellate Division, Second Department, in a separate legal case, vacated the Family Court finding of neglect against Ms. Ogunbayo. The panel investigation showed that

“In fact, the youngsters had “near-perfect” attendance in school and “were doing well, even thriving, academically,” while in their mother’s care,. In addition, the boys were up to date on their medical examinations and vaccinations, and their heights and weights were appropriate for their ages”

There was no evidence, the Appellate panel determined; the children were ever in “imminent danger” of harm despite Ms. Ogunbayo’s refusal to acknowledge her mental condition. But the panel also states

“Proof of mental illness alone will not support a finding of neglect,” unless there’s a causal link between the parent’s condition and actual or potential harm to the child.

The appellate ruling restored custody of the  children to Ms. Ogunbayo, she alleges ACS has still “refused” to return them, that’s why she had to file a lawsuit.

Meanwhile in foster care, court papers explains that her older son was having some problems with the law while in foste care . He was arrested in Queens,  August of last year for alleged marijuana possession. Ogunbayo is also planning to provide handwritten letters from her sons saying they wished to live with their mom, during the case.

I don’t think Ogunbayo filing a 900 trillion dollar suit will help dismiss any claims that she is mentally ill, knowing that the national  debt is only  15 trillion .  Still,  I wish her luck in her pursuit.
